2.4 You may not access or use the Service to make a claim of intellectual property infringement against Docker or to create a product or service that competes with the Service. Predictably, Docker`s announcement sparked a discussion among developers. While many seemed to understand the reasons for the new Docker subscriptions, others expressed dissatisfaction. Criticism has developed along two main axes. On the one hand, some felt that Docker`s decision set a potentially dangerous precedent, with the risk of increasing subscription costs in the future and securing oneself. However, this view does not take into account the higher costs an organization would incur if it had to rely on poorly maintained open source software, others say. In particular, small businesses (less than 250 employees AND less than $10 million in revenue) can continue to use Docker Desktop for free with Docker Personal. However, using Docker Desktop in large enterprises requires a paid Pro, Team, or Business subscription that starts at $5 per user per month. Over the next few months, we`ll be covering the details of this announcement in webinars, community meetings, blog posts, and more. For starters, we have our Community All-Hands on September 16th and our first webinar on the launch of Docker Business on September 23rd – we hope to see you both! And for more details on subscriptions to the updated products, please see docker.com/pricing and FAQ. The updated terms for Docker Desktop reflect our need to scale our business in a sustainable way and allow us to continue to deliver new value to all Docker subscriptions.
These new terms will take effect on August 31, 2021 and there will be a grace period until January 31, 2022 for those who need a paid subscription to use Docker Desktop. (Note that licenses for Docker Engine and upstream open source docker and Moby projects don`t change.) The new service contract only applies to Docker Desktop, which means that Docker Engine and the Moby project are not affected. “Offering” means the level of service, components, and features that you have selected from the Service Description Offerings described on the Pricing page (Personal, Pro, Team, and Enterprise). 5.1 Subject to the Terms, the Service will be provided to you free of charge subject to certain restrictions. Use beyond this limit may require you to purchase additional resources or services. Prices are set at www.docker.com/pricing. The new Docker Business subscription enables enterprise-wide management and security for organizations that use Docker for large-scale software development. With an easy-to-use SaaS management layer, IT managers can now effectively monitor and manage all of their Docker development environments and accelerate their secure software supply chain initiatives. In addition to all the features available in Docker Pro and Docker Team subscriptions, Docker Business offers the ability to control which container images developers can access from Docker Hub to ensure teams build securely from the start using only trusted content. And soon, Docker Business will provide SAML SSO, the ability to control the registries that developers can access, and the ability to remotely manage Instances of Docker Desktop. 20.4 You agree that Docker may send you notices, including those regarding changes to the Terms, by email, post or posting on the Service.
By providing your email address to Docker, you agree that we may use the email address to send you legally required communications instead of communications by mail. You can send us legal notices to our postal address above or by e-mail to support@docker.com. The new terms went into effect on August 31, but Docker gave developers a grace period until January 31, 2022 to comply with the new service agreement and purchase a paid subscription if needed. Developers can choose between Docker Pro, Docker Team, and Docker Business subscriptions. “Additional Services” means additional services that may be offered in the future as additional services at the prices indicated on the pricing page at that time. The new Docker Business subscription is designed for organizations that make extensive use of Docker for application development and need features such as secure software supply chain management, single sign-on (SSO), access controls for container registration, and more. It has an easy-to-use SaaS management layer that enables IT managers to effectively monitor and manage all of their Docker development environments and accelerate their secure software supply chain initiatives. Docker Business also includes image access management, which allows administrators to control which container images developers can access from Docker Hub to ensure teams build securely from the start using only trusted content.
This Docker Subscription Service Agreement (the “Agreement”) is between you and Docker, Inc. (“Docker”) and applies to the Docker Subscription Service (the “Service”). The Terms also apply to all Services or updates to the Service, unless they have expressly different terms. Docker Personal is the new name for the Docker Free subscription. With a focus on open source communities, individual developers, education, and small businesses, Docker Personal will continue to enable free use of Docker components, including Docker CLI, Docker Compose, Docker Engine, Docker Desktop, Docker Hub, Kubernetes, Docker Build and Docker BuildKit, Docker Official Images, Docker Scan, and more. You are solely responsible for your involvement and interactions with other users of the Service.
